Purpose and Scope A. This chapter sets forth rules governing the public notice that must be given in the event of a radioactive release or specific safety related events at any nuclear power plant. B. This rules does not apply to public notification during declared emergencies at a nuclear power plant. Such notification is subject to other requirements of state and federal law, including the State of fb88 Emergency Management Agency Radiological Incident Plan. C. Statutory Authority: 22 MRSA Section 674 and 35-A MRSA Section 4332. 2. Definitions A. "Act" means 35-A MRSA Sections 4331 through 4334. B. "Agency" means the Department of Human Services C. "Batch Release" means the release of gaseous or liquid effluent of a discrete volume. D. "Continuous Release" Means the discharge of gaseous or liquid effluent of a non-discrete volume which is essentially uninterrupted for extended periods during normal operation of the facility. E. "Curie," Ci, is a measurement of radioactivity. One curie is that quantity of radioactive material which decays at the rate of 37 billion nuclear disintegrations per second. Commonly used fractions of the curie are the millicurie, 0.001 Ci and the microcurie, 0.000001 Ci. F. "Day" means a 24-hour period beginning at midnight. G. "Department" means the fb88 Department of Human Services, its Commissioner, his or her designee, or the staff of that Department's Bureau of Health, Division of Health Engineering. H. "Determined" (or a determination) means a qualitative and quantitative evaluation of the radioactive effluents by monitoring and measurement techniques to detect radionuclides at sensitivity levels as specified by the fb88 Yankee operating license. I. "Dose" means the effective dose equivalent. J. "Effective Dose Equivalent" means the product of absorbed dose, quality factor and all other necessary modifying factors found in biological tissue at the location of interest . The units of dose equivalent are the rem, r; and Sievert, Sv. K. "MEMA" means the fb88 Emergency Management Agency, its Director or his or her designee. L. "Notification" means making information readily accessible to the public and other designated agencies through any common and usually accepted means of conveyance of information, such as newspaper, radio, television, and/or toll-free telephone communication. M. "Release" means the gaseous or liquid emission into the environment of any radioactive material generated in or attributable to the operation of fb88 Yankee nuclear power facility. The term release also applies to gaseous releases arising from samples of primary systems and components. N. "Scheduled Release" means the planned or anticipated deliberate release of radioactive material into the environment for which a 24-hour public. pre-notification is given. A scheduled release may be batch or continuous. 0. "Unscheduled Release" means the unanticipated release of radioactive material into the environment for which a 24-hour public pre-notification is not given. 3. Notification of Radioactive Releases A. Events Requiring Notification. 1. Releases of radioactivity; or 2. A breakdown, malfunction or inoperability of safety related equipment reportable under 10 CFR Part 21. B. Individuals to be Notified. fb88 Yankee representatives shall provide notice of a release to: 1. the public; 2. the Commissioner of the Department of Human Services, or the Commissioner's designee; and 3. the Director of the fb88 Emergency Management Agency, MEMA, or the Director's designee. 4. Methods of Notification for Various Events A. Scheduled Releases 1. if a gaseous or liquid release is scheduled, notice of such release shall be through an established toll-free telephone number. The notice must occur at least 24 hours prior to the day of the projected release. Projections of scheduled radioactive effluent releases shall be based on a calendar day. Thus, for example, if a release is projected for any time on Wednesday, the notice must commence no later than 11:59 p.m., Monday. 2. The notice must continue throughout the day that the release is projected to occur, re-stating the original projection. 3. Should the toll-free number become inoperative an cause a failure to comply with Section 4.A.1., a nuclear power plant shall provide notices to the print and electronic media. B. Unscheduled Releases 1. When a gaseous or liquid unscheduled release occurs notice of the unscheduled release shall be made as soon as the required information under Section 5 of these rules is known, but no later.. than 24 hours after discovery. 2. Unscheduled releases must be reported to the Department and to MEMA as soon as possible through commercial telephone lines. 3. The public shall be notified of any such unscheduled release via a toll-free telephone line, or, the electronic media and the print media. 4. When the print media is utilized, the notice must .appear in at least one local or regional newspaper or newsletter with a distribution that includes a ten mile radius of fb88 Yankee. 5. When electronic media is utilized, the broadcast shall be via public and commercial radio or television stations with signal coverage of at least a ten mile radius of fb88 Yankee. C. Breakdown, or Malfunction or Inoperability of Safety Related Equipment Reportable under 10 CFR Part 21 1. Telephone notice shall be made to the State Nuclear Safety Inspector as soon as possible after the discovery of a breakdown, or malfunction or inoperability of any safety related equipment reportable under Part 21, Code of Federal Regulations, Title 10, Energy. 2. Notice to the public of a breakdown, or malfunction or inoperability of safety related equipment shall be made following the determination that a 10 CFR Part 21 event exists. This notice shall be via a toll-free telephone line, the electronic media, or the print media, depending upon the circumstances. 5. Information to be Contained in the Notice A. Notice of a gaseous or liquid release shall include at least the following information: 1. Total amount of radioactivity released. a. For scheduled releases the projection may be modified to account for errors in precision and shall include the total radioactivity to be released, combining batch and continuous releases. Gaseous and liquid releases must be reported separately. b. For each unscheduled release, occurring as a separate event, the notice shall include the total amount of radioactivity released. c. The total curies shall be reported in decimal equivalents (for example: 2.5 curies, 1.6 curies, 0.08 curies). d. For each unscheduled release, the date and time of the release, as well as the duration. 2. The estimated individual dose that may occur as a result of the release. Comparisons, if given to other sources of radiation exposure shall be consistent as to time of exposure. (As an example, comparisons to natural background radiation should be on the basis of average daily or hourly exposure to be consistent with the expected exposure time due to the release of radioactivity from the plant.) 3. A forecast of weather conditions at the time of the release. A. The reported conditions should accurately reflect weather conditions most recently predicted for the vicinity of the plant at the time of the release. B. For notices regarding unscheduled releases, data from the fb88 Yankee meteorological tower and from direct observation of weather conditions should be used. 4. The area downwind from the release specified for the period of the release. The wind direction shall be given using the word "from." For example, the wind was from the Northeast at 8 miles per hour. 5. An explanation of the event, equipment malfunction, operator error, or other condition that caused the release. 6. Immediate corrective actions taken, for example, to remedy a malfunction or terminate the unscheduled release. B. Breakdown of Safety Related Equipment 1. When a breakdown of safety related equipment occurs pursuant to Section 3.B.2, the notice shall include the equipment that malfunctioned and the error or other condition that led to the breakdown or malfunction in addition to the remedy to the situation. 2. If the aforementioned event results in a release, as defined in Section 2, a notice shall be given as indicated in Sections 3.A and 4.C. If no release occurs, any form of notice described in Section 4 may be utilized. 6. Written Reports A. Release permits shall be submitted to the Department of Human Services, Office of Nuclear Safety. B. The State Nuclear Safety Inspector shall have access to any and all reports, analyses or investigations regarding scheduled or unscheduled releases. C. A transcript, or summary, of the information that was disseminated in the public notice for each scheduled release, unscheduled release, or malfunction of 10 CFR Part 21 safety related equipment shall be submitted to Office of the State Nuclear Inspector within 48 hours of the initial notice.
