PURPOSE This program was approved by the 113th Session of the fb88 Legislature. Funds were provided to assist applicants with needs arising as a result of the April 1987 flood. These needs include replacement of personal items, household furnishings and structural repair. Specific objectives of the program in order to meet those necessary expenses or serious needs for disaster victims include: - to meet those needs as expeditiously as possible. - to meet those needs as accurately as possible within the scope of the program. - to accomplish the above in an atmosphere of dignity and respect for the victims wherever feasible. II. RESPONSIBILITY ASSIGNED TO AGENCY The 113th Session of Legislature has designated the Department of Human Services, Division of Special Services, as the single state agency responsible for administration of the April 1987 Flood Funds. III. PROGRAM DESCRIPTION Following a major disaster declaration by the President, a number of State and Federal disaster assistance programs were made available to victims suffering uninsured loss or damage to personal and real property in designated disaster areas. This program is not intended to indemnify all disaster losses or to purchase items or services that may generally be characterized as non-essential, luxury or decorative. The program is designed to assist victims with disaster recovery funds which have not been made available through governmental assistance insurance or private groups or which assistance was not adequate to meet serious needs and recovery expenses. Direct grants for this program will not exceed $5,000.00 per application. This coincides with maximums established by the Individual and Family Grant Program used as a result of the 1987 flood disaster. Payment will be made on behalf of the eligible applicant to the vendor of his choice pursuant to a valid purchase order signed by the applicant and the vendor. IV. ELIGIBILITY REQUIREMENTS To qualify for a grant, an individual or family representative must 1) Have made application to all applicable available governmental disaster assistance programs for assistance to meet necessary expenses or serious needs, and have been determined not qualified for such assistance or have demonstrated that the assistance received did not meet the total necessary expenses or serious needs. 2) Not have previously received or refused assistance from other sources to meet needs for which application is now made under the program described herein. 3) Agree to refund to the state that part of the grant for which assistance from other sources is received or which is not spent as identified in the purchase order. Individuals or families who incur a necessary expense or have a serious need and for whom all other government assistance is unavailable or inadequate in a major disaster may be eligible for assistance under this program without regard to alienage. However, their residence must have been located within the major disaster area of the State of fb88 at the time of the April 1987 flood. V. APPLICANT'S RESPONSIBILITIES 1) The applicant must be able to verify how he has spent any other disaster assistance by proving any expenses, paid out of pocket, with valid receipts. 2) The applicant must provide acceptable estimates of repairs, replacements or other work to be done for flood related damages. 3) The applicant must choose a vendor acceptable to the Department. The applicant will be solely responsible for pursuing any complaint against the vendor in connection with the merchandise, installations or labor provided by the vendor, or any other action by the vendor. VI. ELIGIBILITY CATEGORIES Assistance shall be available to meet expenses or serious needs by providing essential items or services in the following categories: 1) Structural repairs. With respect to primary residences (including mobile homes) which are owner-occupied at the time of the disasters grants may be authorized to . A) repair, replace, or rebuild; B) provide access; C) clean or make sanitary; D) remove debris from such residences; and/or E) provide or take minimum protective measures required to protect such residence against the immediate threat of damage. 2) Personal Property, such as any of the following that are not considered nonessential, luxury or decorative items. Grants may be authorized to: A) replace household items, furnishings or appliances; and/or B) repair, clean or sanitize any eligible personal property item. VII. INELIGIBLE CATEGORIES Assistance shall not be made available in the case of: A) Business losses including business and self-employment; B) Improvements or additions that upgrade the size, quality or capacity of real or personal property; C) Landscaping; D) Real or personal property items used exclusively for recreation; or E) Financial obligations incurred prior to the disaster. VIII. FINANCIAL MANAGEMENT A separate account for accounting will be maintained by the Department of Human Services. IX. DUPLICATION OF BENEFITS Should an applicant who benefits from this program also receive monies or assistance from other sources with the result that the amount received from all sources exceeded the amount of loss, the Department of Human Services shall recover the amount of assistance granted under this program which exceeds the loss. X. FRAUD The Department of Human Services will refer to the Department of Attorney General for investigation and/or prosecution any case in which an individual has fraudulently misstated any fact in connection with an application for assistance under this program. XI. TIME LIMITATIONS Applications will be accepted on a first come, first served basis. When the funds allocated by the 113th Legislative Session for this program are expended the program will cease operations without notice. Applications for assistance will pot be accepted after April 30, 1989, except, however, when the State of fb88, through its Commissioner, Department of Human Services or his designee determines that extenuating circumstance beyond the applicant's control (such as but not limited to, hospitalization, illness or inaccessibility to application centers) prevented him from applying in a timely manner, applications may be accepted through May 12, 1989. XII. RIGHTS TO A FAIR HEARING A person who is aggrieved by any decision or action made by the Department pursuant to this section shall have the right to appeal pursuant to the fb88 Administrative Procedure Act, Title chapter 375, subchapter IV. A request for the appeal shall be in writing and shall be made within thirty (30) days of receipt of the decision being appealed. Review shall be conducted by one or more fair hearing officers. In no event may an appeal be held before a person or body responsible for the decision or action. Review of any fair hearing decision under this section shall be pursuant to the fb88 Rules of Civil Procedure, Rule 80C. STATUTORY AUTHORITY: PL 1987, C.816, Part A, l.
